DMG Attorneys Sean Sullivan and Laura Platt recently secured a summary judgement win on behalf of BNSF Railway Company in the Circuit Court of Cook County, Illinois. The plaintiff alleged that exposure to toxic substances caused his bladder cancer and the occupational lung disease - asbestosis.  

On April 8, 2019, the Appellate Court of Illinois Second District affirmed the defense judgment that Sean Sullivan, Kathryn Doi, and Pam Nehring obtained on behalf of their client BNSF Railway Company.  

Following a three-week bench trial, DMG lawyers Sean Sullivan, Kathryn Doi and Pam Nehring secured a defense judgment for client BNSF in an environmental property damage case arising from the release of up to 7,000 gallons of diesel fuel.  

DMG attorneys won summary judgment for a railroad construction client in the Southern District of Texas.  

​Dan Mohan represented BNSF in the first ever Federal Railroad Safety Act (FRSA) Whistle Blower case tried before a jury in Chicago, the case of Glen Armstrong v. BNSF. On September 21, 2016, the twelve-person jury in the U.S. District Court for the Northern District of Illinois unanimously rendered a verdict of no liability.  

DMG's Dan Mohan secured a not-guilty jury verdict against the plaintiff's request for $2,600,000 in damages in Tenesha Martin v. Canadian Pacific Railway.  

Dan Mohan obtained summary judgment for Canadian Pacific Railway in a FELA case brought by a carman who claimed he injured his knee when he slipped on ballast while he was inspecting and repairing trains in the rail yard.
